Privacy Policy

This privacy policy is applicable to the Moon Calendar app (hereinafter referred to as “Application”) for mobile devices, which was developed by Carlos Colado Molina (WebAppDev) (hereinafter referred to as “Service Provider”) as an Ad Supported service with optional subscriptions. This service is provided “AS IS”.

What information does the Application store on your device?

Your settings (notification preferences, widget style, display options, your privacy choices and your answer to the age question) and, only if you allow it, your approximate location are stored only on your device. The Application does not create any account and the Service Provider cannot see this information. Uninstalling the Application deletes all of it.

Does the Application use my location?

Only if you allow it. If you grant the approximate (coarse) location permission, the Application uses your approximate position to calculate the moonrise and moonset times for your area. The calculation is done on your device: the Application does not send your location to the Service Provider’s servers. You can refuse or withdraw the permission at any time from your device settings; the rest of the Application works without it.

The Application does not collect precise (GPS-level) real time location information of your device. The advertising provider (Google AdMob) may process your approximate (coarse) location, derived for example from your IP address, solely to serve and measure advertising, in accordance with its own privacy policy.

Notifications

If you allow notifications, the Application schedules a daily reminder with the phase of the Moon on your device. It is created locally: no notification token or device identifier is sent to the Service Provider. You can turn notifications off at any time from your device settings.

What information is sent to the Service Provider’s server?

To download its content (texts about the Moon), the list of other apps by the Service Provider and its configuration (for example notices, advertising settings and update checks), the Application connects to the Service Provider’s server and sends only: the identifier and version number of the Application, the language of your device and the identifiers of the in-app notices you have already seen. As with any internet connection, the server also receives the IP address of your device, which is used only to deliver the response and in technical logs kept for security purposes. No name, account, location, advertising identifier or device identifier is sent.

What information is collected automatically?

The third-party services the Application relies on (Google Play Services and Google AdMob) may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile operating system, the IP address of your device, your device’s advertising identifier, crash and diagnostic information, and information about the way you interact with the advertisements.

Advertising, consent and age

The Application shows advertisements provided by Google AdMob, which may use your device’s advertising identifier to serve and measure ads. You can reset or delete the advertising identifier at any time from your device settings. Where required by law (for example in the European Economic Area and the United Kingdom), a consent message is shown before any personalised advertising is served; you can choose non-personalised ads instead, change your choice later from the Application’s menu (“Privacy settings”), or remove advertising with the optional premium subscription.

The Application may ask whether you are of legal age and, where available, may use the Google Play Age Signals API, through which Google Play may tell the Application whether the user is a minor. This information is used only to apply child-appropriate advertising settings (non-personalised ads and content suitable for minors) and to comply with the law. It is stored only on your device and is not sent to the Service Provider.

Purchases and subscriptions

The optional premium subscriptions are sold and processed by Google Play under its own terms: the Service Provider does not receive or store your payment details; Google Play only informs the Application whether a subscription (or the former one-time purchase) is active.

Do third parties see and/or have access to information obtained by the Application?

No personal data is sold or shared by the Service Provider with third parties. Only aggregated, anonymized data is periodically transmitted to external services to aid the Service Provider in improving the Application and their service.

The Service Provider may disclose Automatically Collected Information:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • when they believe in good faith that disclosure is necessary to protect their rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • with their trusted services providers who work on their behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

What are my opt-out rights?

You can halt all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also withdraw the location and notification permissions from your device settings, change your advertising choices from “Privacy settings” in the Application’s menu, and reset or delete your advertising identifier from your device settings.

Data Retention Policy, Managing Your Information

The Application does not upload your settings, your location or any content you create; they remain on your device until you uninstall the Application. The Service Provider will retain the technical server logs and Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you would like to exercise your rights of access, rectification, erasure, restriction, objection or portability under the GDPR, please contact the Service Provider at mejortarots@gmail.com and we will respond in a reasonable time; you may also lodge a complaint with your data protection authority (in Spain, the Agencia Española de Protección de Datos).

Children

The Service Provider does not use the Application to knowingly solicit data from or market to children under the age of 13.

The Application does not address anyone under the age of 13. The Service Provider does not knowingly collect personally identifiable information from children under 13 years of age. In the case the Service Provider discover that a child under 13 has provided personal information, the Service Provider will immediately delete this from their servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact the Service Provider (mejortarots@gmail.com) so that they will be able to take the necessary actions.

Security

The Service Provider are concerned about safeguarding the confidentiality of your information. Communication between the Application and the Service Provider’s server travels encrypted (HTTPS). For the information we process and maintain, the Service Provider provide physical, electronic, and procedural safeguards. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes

This Privacy Policy may be updated from time to time for any reason. The Service Provider will notify you of any changes to the Privacy Policy by updating this page with the new Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

Your Consent

By using the Application, you are giving your consent to the Service Provider processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information.

Terms of Use

Welcome to Moon Calendar (the “Application”). These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User” or “you”) and Carlos Colado Molina (WebAppDev) (“Service Provider”, “we”, “us”, or “our”) concerning your access to and use of the Application.

By downloading, installing, or using the Application, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Application and must discontinue use immediately.

1. Description of Service & Eligibility

Moon Calendar is an informational and entertainment mobile application that shows the phases of the Moon day by day, its illumination, its zodiac sign, moonrise and moonset times, eclipses and the traditional names of full moons, together with texts about the energy of each phase and traditional advice (for example about gardening or household tasks). It also offers optional reminders and a home screen widget.

Age Requirement: You must be at least 13 years of age to use this Application. If the law of your country requires a higher minimum age to consent to the processing of personal data, you must meet that age or have the consent of a parent or guardian.

No Registration: The Application does not require, nor does it allow, the creation of user profiles, logins, or registered accounts.

2. Informational Purpose & Disclaimer

Astronomical data (phases, illumination, moonrise and moonset times, eclipses) are calculated by the Application and are approximations: they may differ by several minutes from official sources and depend on your location and time zone. They must not be used for navigation, safety-critical, scientific or professional purposes.

Astrological, esoteric and traditional content (the Moon’s zodiac sign, the energy of each phase, rituals, folk traditions and the advice about gardening, beauty, health or household tasks) reflects popular beliefs and cultural traditions. It is provided for entertainment and general information only, has no scientific basis, and is not medical, psychological, financial or any other professional advice. You assume full responsibility for any decision or action you take based on the Application.

3. Subscriptions

The Application offers optional auto-renewing premium subscriptions (for example of 3, 6 and 12 months). A premium subscription includes the removal of advertisements and the premium home screen widget, and supports the continued development of the Application. Prices are those shown in Google Play at the time of purchase.

Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before it ends. You can manage and cancel subscriptions at any time from your Google Play account settings; uninstalling the Application does not cancel a subscription. When a subscription is cancelled, the premium benefits remain active until the end of the period already paid, and the amount paid for that period is not refunded. Purchases are processed by Google Play under its own terms, and any refund request is governed by the Google Play refund policy. The Service Provider does not process payments or store payment information.

Previous one-time premium purchase. Earlier versions of the Application offered a one-time premium purchase. That purchase is no longer available, but it remains fully valid: users who made it keep the premium benefits (removal of advertisements and the premium widget) permanently, at no additional cost and without needing a subscription. The purchase is restored automatically through Google Play on any device signed in with the Google account that made it.

4. Notifications & Widget

Reminders and the home screen widget depend on your device’s operating system, its battery optimisation and its permissions. The Service Provider does not guarantee that they will be shown at an exact time or at all times, and is not responsible for missed or delayed reminders.

5. Prohibited Uses

You agree not to use the Application to:

  • Use automated scripts, bots, emulators, or scrapers to extract content or overload the Service Provider’s servers.
  • Attempt to bypass advertisements or the premium subscriptions.
  • Reverse-engineer, decompile, or tamper with the Application or its communication with the Service Provider’s servers.
  • Copy, redistribute or publish the content of the Application (texts, images and illustrations) for commercial purposes.

6. Intellectual Property

The Application, including its source code, texts, images of the Moon, artwork, illustrations, graphics, UI design, and trademarks, is the exclusive property of Carlos Colado Molina (WebAppDev) or is used under licence. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Application on your personal device for personal, non-commercial purposes. Images you create with the Application’s share feature may be shared for personal, non-commercial use.

7. Limitation of Liability

The Application is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, the Service Provider shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use of, or inability to use, the Application, including inaccurate astronomical data, decisions taken on the basis of its content, missed reminders, server downtime, or advertising failures.

8. Changes to the Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time. We will alert you about any changes by updating the “Effective Date” of these Terms. Your continued use of the Application after the date such revised Terms are posted constitutes your acceptance of the changes.

9. Governing Law

These Terms and your use of the Application are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law principles.
