Privacy Policy

This privacy policy is applicable to the Medicinal Plants app (hereinafter referred to as «Application») for mobile devices, which was developed by Carlos Colado Molina (WebAppDev) (hereinafter referred to as «Service Provider») as a an Ad Supported service. This service is provided «AS IS».

What information does the Application obtain and how is it used?

Automatically Collected Information

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

Does the Application collect precise real time location information of the device?

This Application does not collect precise real time location information of your device. The advertising provider (Google AdMob) may process your approximate (coarse) location, derived for example from your IP address, solely to serve and measure advertising, in accordance with its own privacy policy.

Do third parties see and/or have access to information obtained by the Application?

Only aggregated, anonymized data is periodically transmitted to external services to aid the Service Provider in improving the Application and their service. The Service Provider may share your information with third parties in the ways that are described in this privacy statement.

Please note that the Application utilizes third-party services that have their own Privacy Policy about handling data. Below are the links to the Privacy Policy of the third-party service providers used by the Application:

The Service Provider may disclose User Provided and Automatically Collected Information:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • when they believe in good faith that disclosure is necessary to protect their rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • with their trusted services providers who work on their behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

 

What are my opt-out rights?

You can halt all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

Data Retention Policy, Managing Your Information

The Service Provider will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. The Service Provider will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like the Service Provider to delete User Provided Data that you have provided via the Application, please contact them at mejortarots@gmail.com and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

Children

The Service Provider does not use the Application to knowingly solicit data from or market to children under the age of 13.

The Application does not address anyone under the age of 13. The Service Provider does not knowingly collect personally identifiable information from children under 13 years of age. In the case the Service Provider discover that a child under 13 has provided personal information, the Service Provider will immediately delete this from their servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact the Service Provider (mejortarots@gmail.com) so that they will be able to take the necessary actions.

Security

The Service Provider are concerned about safeguarding the confidentiality of your information. The Service Provider provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve their Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes

This Privacy Policy may be updated from time to time for any reason. The Service Provider will notify you of any changes to the Privacy Policy by updating this page with the new Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

By using the Application, you are giving your consent to the Service Provider processing of your information as set forth in this Privacy Policy now and as amended by us. «Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information.

Terms of Use

Welcome to Medicinal Plants (the «Application»). These Terms of Use («Terms») constitute a legally binding agreement between you («User» or «you») and Carlos Colado Molina (WebAppDev) («Service Provider», «we», «us», or «our») concerning your access to and use of the Application.

By downloading, installing, or using the Application, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Application and must discontinue use immediately.

1. Description of Service & Eligibility

Medicinal Plants is an informational mobile application that offers a catalogue of plants traditionally used in herbal medicine, with a description of the properties, uses and precautions attributed to each of them. As an optional feature, the Application can try to identify a plant from a photo taken with your device, using artificial intelligence provided through OpenAI API technologies.

Age Requirement: You must be at least 13 years of age to use this Application. If the law of your country requires a higher minimum age to consent to the processing of personal data, you must meet that age or have the consent of a parent or guardian.

No Registration: The Application does not require, nor does it allow, the creation of user profiles, logins, or registered accounts.

2. Informational Purpose & Health Disclaimer

All content in the Application (descriptions, properties, therapeutic uses, preparations, dosages and precautions) is provided for general informational and educational purposes only. It reflects traditional and popular uses of plants and is not medical advice, diagnosis, or treatment, and it does not replace the consultation of a qualified physician, pharmacist, or other healthcare professional.

Plants can be toxic, cause allergic reactions, interact with medicines, or be dangerous during pregnancy, breastfeeding, for children, or for people with certain conditions. Never start, stop, or change a treatment, and never consume or apply a plant, on the basis of the information provided by the Application. Always consult a healthcare professional first and, in case of poisoning or an adverse reaction, contact the emergency services of your country immediately.

The Service Provider makes no guarantees regarding the accuracy, completeness, or currency of the content, which may contain errors. You assume full responsibility for any choices or actions you take based on the information provided by the Application.

3. AI Plant Identification & Fair Use

The plant identification feature is optional and is provided as an aid, never as a certainty. Identification is performed by an artificial intelligence system from a photograph and may be wrong, including confusing an edible or medicinal plant with a toxic look-alike. You must never eat, drink, apply, or otherwise use a plant on the basis of an identification made by the Application. When in doubt, consult a botanist, a pharmacist, or a qualified professional.

The feature only tries to match the photo with the plants included in the Application's catalogue; a plant that is not in the catalogue cannot be identified. For users without an active premium subscription, access to the feature may require watching a rewarded advertisement.

Because each identification has a real cost to the Service Provider, who pays a third-party provider for each request, the feature is subject to reasonable usage limits (a maximum number of identifications per device in a given period). These limits apply to all users, including premium subscribers, and are intended solely to prevent abuse and keep the service available for everyone. The Service Provider may limit, suspend, or restrict the feature for a device that exceeds these limits or shows abusive or automated behaviour.

The feature depends on third-party services outside the Service Provider's control and is not guaranteed to be available at all times: it may suffer outages, delays, or errors at any moment. The Service Provider does not guarantee that the feature will remain available at every moment and may modify or limit it in order to keep it working for everyone. Should the feature become unavailable for an extended period during a paid subscription, the remaining benefit of the subscription (removal of advertisements) stays in force; refunds, where applicable, are handled by Google Play under its refund policy.

3.1 Photos You Submit

Submitting a photo for identification is entirely optional. When you do so, the photo is transmitted to the AI provider for processing and may be retained by the Service Provider for a limited period, associated with a device identifier and not with your name or identity, for the limited purposes of preventing abuse, diagnosing errors, and monitoring the quality of the identification service. Photos are not published, not shared with other users, and not used for advertising or profiling.

Please photograph only the plant. Do not include people, faces, documents, licence plates, or any other personal information in the photos you submit. Any such information contained in a photo is submitted voluntarily and at your own initiative; the Service Provider does not request it and cannot prevent you from including it.

4. Purchases & Subscriptions

The Application offers optional auto-renewing premium subscriptions (weekly, monthly, and quarterly). A premium subscription includes: (a) the removal of advertisements, and (b) the use of the AI plant identification feature without watching rewarded advertisements, subject to the fair use limits and the availability conditions described in Section 3. The AI feature has an ongoing cost to the Service Provider for each identification; the subscription is what funds it.

Subscriptions renew automatically at the end of each period at the price shown in Google Play at the time of purchase, unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions at any time from your Google Play account settings; uninstalling the Application does not cancel a subscription. When a subscription is cancelled, the premium benefits remain active until the end of the period already paid, and the amount paid for that period is not refunded.

Subscriptions are processed by Google Play under its own terms, and any refund request is governed by the Google Play refund policy. The Service Provider does not process payments or store payment information.

Previous one-time premium purchase. Earlier versions of the Application offered a one-time premium purchase whose object was the removal of advertisements. That purchase is no longer available, but it remains fully valid: users who made it keep the removal of advertisements permanently, at no additional cost and without needing a subscription. The purchase is restored automatically through Google Play on any device signed in with the Google account that made it.

The AI plant identification feature did not exist when that purchase was offered and was not part of it. As a courtesy, users with the former one-time purchase may also use the AI feature without watching advertisements, subject to the fair use limits described in Section 3. Because each identification has an ongoing cost to the Service Provider, this courtesy may be limited, modified, or withdrawn at any time and without prior notice, and its limitation or withdrawal does not entitle those users to any refund or compensation; the removal of advertisements they purchased remains in force in all cases.

5. Prohibited Uses

You agree not to use the Application to:

  • Use automated scripts, bots, emulators, or scrapers to request identifications, extract the catalogue, or overload the paid API endpoints.
  • Attempt to bypass advertisements, usage limits, or the premium subscriptions.
  • Reverse-engineer, decompile, or tamper with the Application or its communication with the Service Provider's servers.
  • Submit photos that are illegal, that depict other people without their consent, or that are unrelated to plants with the purpose of abusing the identification service.
  • Present the content of the Application as professional medical advice to third parties.

6. Intellectual Property

The Application, including its source code, texts, plant descriptions, photographs and illustrations, graphics, UI design, and trademarks, is the exclusive property of Carlos Colado Molina (WebAppDev) or is used under licence. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Application on your personal device for personal, non-commercial purposes.

7. Limitation of Liability

The Application is provided on an «AS IS» and «AS AVAILABLE» basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, the Service Provider shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use of, or inability to use, the Application, including damages to health resulting from the consumption or application of any plant, incorrect identifications, data loss, server downtime, advertising failures, or third-party API failures.

8. Changes to the Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time. We will alert you about any changes by updating the «Effective Date» of these Terms. Your continued use of the Application after the date such revised Terms are posted constitutes your acceptance of the changes.

9. Governing Law

These Terms and your use of the Application are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law principles.
